  1. Use of the facilities

Power Rheintal GmbH (hereinafter "KRAFTWERK Fitness") provides the member with all facilities used for training during official opening hours in accordance with the separate gym rules for use during the contract period against the agreed user fee. The opening hours of KRAFTWERK Fitness are announced in the gym rules or by posting. Changes to the opening hours or training facilities remain reserved. The usage rights are personal, non-transferable, and not intended for third parties. The member is obliged to register their presence before each training session using the check-in system.

  1. Doping-free

KRAFTWERK Fitness is committed to a doping-free sport. The member undertakes to refrain from any form of doping.

  1. Health status

By signing the contract, the member confirms that they are healthy enough to do sports. In case of doubt, a medical examination must take place before registration. However, a medical certificate is not required.

  1. Own risk

The facilities are used at the member's own risk and danger. Any liability of KRAFTWERK Fitness is excluded to the extent permitted by law.

  1. Operational interruptions

Operational interruptions due to cleaning, repairs, coincidence, force majeure, or official orders (e.g. pandemic, epidemic, legal closures) do not entitle to a refund. If such interruptions exceed a total of four weeks during a contract year, the contract is automatically extended by the duration of the exceeding interruptions. Further claims of the member are excluded. Special regulations apply on public holidays.

  1. Member preventions

Personal preventions such as illness, accident, pregnancy, holidays, professional commitments, or other reasons do not release from the contractual obligations and do not entitle to a refund. In the event of a medically confirmed permanent illness, longer military service, or hardship cases, the contract can be paused for a certain period of time upon written request and in agreement with KRAFTWERK Fitness. In this case, the contract is extended by the period of the pause. The agreed payment method remains unchanged.

  1. No refund

Refunds of payments already made are excluded in any case, regardless of the reason for non-use (e.g. illness, accident, pregnancy, holidays, professional preventions, officially ordered closures). Any goodwill solutions (e.g. contract interruption or credits) are solely at the discretion of KRAFTWERK Fitness and do not constitute a legal claim.

  1. Relocation of location

The relocation of the fitness rooms within a radius of 10 km remains reserved for KRAFTWERK Fitness.

  1. Gym rules / contract violations

The gym rules are an integral part of this contract. If the member seriously violates them, KRAFTWERK Fitness is entitled to terminate the contract without notice. In this case, there is no claim to a refund.

  1. Liability for valuables

KRAFTWERK Fitness is not liable for damage, loss, or theft of valuables or clothing brought along.

  1. Price changes

Increases in the user fee are possible up to a maximum of 20% of the previous amount and will be announced in writing or by posting at least one month in advance.

  1. Contract period

The contract is concluded for a specific duration. The start of the contract is the agreed training start. The obligation to pay exists throughout the entire contract period, regardless of actual use.

  1. Changes and additions

Changes and additions to this contract must be in writing.

  1. Place of jurisdiction

The place of jurisdiction for all disputes arising from this contract is the respective registered office of Power Rheintal GmbH, currently 9435 Heerbrugg.
